Consultation launched on speeding up UK planning change
UK planning and housing minister Brandon Lewis has proposed new measures to speed up the planning system and provide new homes more quickly. He explained that so-called section 106 agreements, which attach conditions on a planning permission being granted, can often lead to extended negotiations that delay the planning application process. Now Lewis is seeking views on plans to speed up the process, getting planning permission agreed and workers on site more quickly. He said they can add months to the planning process and stalling work on the homes communities want. ‘Section 106 planning agreements can bring great benefits to local communities but too often they drag out planning applications for months. I’m proposing measures that will speed up the process, get planning permissions granted quicker and workers on site earlier, all the while keeping the community benefits that these agreements can bring,’ he explained. Section 106 agreements put requirements on planning applicants to make the proposals suitable for the area. These include mitigating a scheme’s impact such as through requiring improved transport to service it, providing an affordable housing element or requiring contributions from the applicant to be spent on other local schemes. The proposals are now open for consultation and include setting clear time limits so section 106 negotiations are completed in line with the existing eight to 13 week target for planning applications to be processed rather than letting them slow the whole planning process down. They also include requiring parties to start discussions at the beginning of the planning application process, rather than the current system where negotiations can often start towards the end. There are plans for a dispute resolution process where negotiations stall preventing development, using standardised documents to avoid agreements being drafted from scratch for each and every application and potential legislation in the next Parliament to give the new measures teeth. Lewis pointed out that this is the latest in a range of measures the government has taken to improve the planning system. Others include introducing the National Planning Policy Framework to cut more than 1,000 pages of planning guidance to around 50 and making it easier to convert existing commercial and retail buildings for residential use. Also on the agenda is removing the requirement for affordable housing and other contributions from small developers, saving up to £140,000 per home and at the same time maintaining strong protections for the green belt, which continues to prevent urban sprawl. The consultation on these proposals runs until 19 March 2015 and also seeks views on removing the need to contribute to affordable housing where a developer is building student accommodation. Proposals published on improvements for buyer and seller protection in Scotland
The Law Society of Scotland has published a report following an independent review of consumer protections for people buying and selling property in Scotland. The review, by former Sheriff Principal Edward Bowen, examined the current consumer protections in place as well as conveyancing practice and the existing legal framework. It followed high profile and complex cases in Aberdeenshire and West Lothian where clients were left without proper title to land bought through residential property transactions. The Law Society provides a number of consumer protections for people using Scottish solicitors. This includes its Guarantee Fund, a fund of last resort which seeks to compensate clients who are the victims of a solicitor’s dishonesty. The Society also arranges for the Master Policy, a single policy of professional indemnity insurance, to ensure firms are covered for cases involving negligence. Bowen concluded that the cases in Aberdeen and West Lothian arose for very different reasons and were highly complex and unusual, and did not suggest a fundamental problem with conveyancing practice. His report makes a number of recommendations, including consideration of the widening of the scope of the Guarantee Fund, and a possible change to the name of the fund to avoid confusion. Some changes would be likely to require changes to the legislation governing the fund. It also recommends amending the guidelines for discretionary powers for the Guarantee Fund to provide discretionary assistance in restricting continuing losses in certain circumstances and the possible introduction of a new system of protection for purchasers of newly constructed houses to protect from insolvency. This would have to be brought forward by Scottish Ministers. ‘We have an important duty to protect the interests of the consumers of legal services, a responsibility which we take extremely seriously. The vast majority of Scottish solicitors provide an excellent service for their clients, but we need to ensure that we have a robust set of consumer protections to help clients in those very few occasions when things go wrong,’ said president of the Law Society of Scotland, Alistair Morris. ‘These difficult and very complicated conveyancing cases in West Lothian and Aberdeenshire left some questioning if the existing protections are sufficient. That is why we commissioned an independent review to look at the issues arising from these cases, current conveyancing practice and existing Scots law, to see what lessons can be learned for the future,’ he explained. ‘Overall, the report provides reassurance that there are no fundamental or underlying problems with Scots property law and solicitors’ conveyancing practice. It is notable that Sheriff Principal Bowen has concluded that the cases in Aberdeen and West Lothian arose for very different reasons and were highly complex and unusual,’ he added. Straw houses go onto UK general sales market
Houses made of straw are on sale on the open market for the first time in the UK after becoming eligible for standard mortgages. Until now the eco-homes have been the preserve of bespoke building projects and financed through specialist lenders but now a row of seven straw houses in Bristol have now become the first to secure building certification which makes them eligible for a standard mortgage. The two and three bedroom properties will each use more than seven tonnes of straw and reduce heating costs by 90% compared to the average brick house, according to Professor Pete Walker from the University of Bath who led a project to develop and test the construction method. They homes are due to be completed in April and are on sale priced between £220,000 and £240,000. ‘I think there's a lot of misconception about using straw, especially about fire resistance. As a construction material straw is a low cost and widely available product that offers real potential for ultra low carbon housing throughout the UK,’ said Walker. ‘Building with straw could be a critical point in our trajectory towards a low carbon future. The great thing about the houses is that they are affordable and in addition the energy costs will be extremely low, under £100 a year,’ he explained. The houses are currently undergoing a 10 week construction programme by developers Connolly and Callaghan in Shirehampton, Bristol. Each wall is the same thickness as a normal bale of straw, framed in timber and encased in wooden boards. In addition compressed straw board will line the walls throughout the house as a replacement for plaster board and once built, the terraced houses will be clad in brick so they will be indistinguishable from the other properties in the street. The only hint of their remarkable construction method will be a 'truth window' in each property where a section of straw wall will be visible through a window. Although these are not the first houses in the UK to be built using straw bales, they are the first to be built for any buyer on the open market. The straw design has received BM Trada's Q mark certification, meaning developers and house buyers can now insure and secure mortgages against the homes. ‘First and foremost the work has demonstrated that straw bales create safe, durable and affordable houses. They make contributions to reducing fuel poverty and make significant contributions to reducing energy bills of building occupants,’ Walker pointed out.
